Pre-17 Driving Experience Terms – WrightStart Experiences Ltd

INTRODUCTION

These terms apply to Pre-17 Experiences offered by WrightStart Experiences Ltd. Every effort is made to ensure the descriptions, prices and illustrations contained within the website and on gift vouchers are a true reflection of the events or products, these do not form part of a contract. Once a specific date has been booked, you will automatically become bound by our terms and conditions. Please note that experiences and other products are subject to change without notice. This does not affect your statutory rights.

SECTION 1 – BROCHURE, WEBSITE DESCRIPTIONS AND PRICES

All images and brochures used by WrightStart are protected by copyright and must not be copied or used in whole or in part without the permission of WrightStart. All images and brochures used for driving experiences are for illustration purposes and are used as an indication of the experience. WrightStart reserves the right to change or remove images from the website at any time. All discounts codes can only be used against the experience cost, not on additional extras such as videos, photos, souvenirs, damage waiver policy etc.

SECTION 2 – PAYMENT

Full payment is required at the time of purchase. We are unable to delay payment or make provisional bookings unless credit terms have been agreed. We reserve the right to cancel any order where full payment has not been received within credit terms or where payment has defaulted. Any vouchers issued in these circumstances become void without further notice and we will withhold all reasonable costs incurred.

SECTION 3 – RESTRICTIONS

Children (under 18) attending the venue must be accompanied by an adult (over 18). Alcohol and drugs are strictly forbidden on the premises. Any medical condition or disability must be disclosed to WrightStart at time of booking. For all adult driving experiences the customer must hold a full UK driving licence.

It is the purchaser’s responsibility to make certain that you purchase an experience suitable for the proposed beneficiary and it is the responsibility of the recipient to double check that the restrictions are not prohibitive.

SECTION 4 – EXPERIENCE AVAILABILITY

All experiences are offered subject to availability and weather conditions on the day. It may be necessary to book experiences well in advance due to demand. We are unable to make provisional reservations. You are advised not to make travel, hotel or other arrangements until your booking has been confirmed. WrightStart will not be held liable for the cost of lost insurance premiums, travel expenses, pre-booked accommodation or any other costs incurred. Once a booking is confirmed it cannot be changed or amended.

All experience bookings and vouchers must be redeemed by 16 October 2022.

SECTION 5 – BOOKINGS

Once a date is booked and confirmed you are bound by our terms and conditions. Once a booking is made it is a confirmed booking and cannot be changed. In the unlikely event that we need to cancel the experience after you have confirmed a date, we will contact you direct to reschedule.

It is your responsibility to ensure you arrive on time for your experience, if you have missed your session your experience will be forfeited.

SECTION 6 – VOUCHER PACKS AND TANGIBLE ITEMS

Gift vouchers are valid for 10 months. Voucher Validity is from the date of purchase unless otherwise stated. The experience must be completed prior to the expiry date on the voucher or the end of the current Pre-17 season, whichever is sooner.

Vouchers are dispatched by First Class Royal Mail you may request Special Delivery for an additional charge. WrightStart will not be held responsible for loss suffered as a result of mail being delayed. If the recipient is unable to accept delivery of voucher packs or other items then additional charges may need to be paid to replace any Items if required.

SECTION 7 – LIABILITY AND SAFETY

Many of the experiences featured involve some personal risk. You will be required to sign a disclaimer before you to take part. With all our experiences the instructors assess a participant’s ability to take part. We reserve the right to refuse any person from participating in any experience should we deem it necessary.

By redeeming your experience voucher, you acknowledge that the experiences are dependent on certain factors beyond WrightStart’s control. WrightStart shall not be liable for the cancellation, postponement or alteration of any experience for reasons beyond their control including for weather-related reasons, mechanical failure, and location changes or otherwise.

SECTION 8 – COMPLAINTS

In the unlikely event of a complaint arising you are advised to speak to a member of staff on the day of the experience to resolve any issues. Should you still not be satisfied please email details of your complaint (including your voucher reference number and who you spoke to on the day) to [email protected]

SECTION 9 – REFUNDS

We are only able to offer refunds when customers are legally entitled within 10 days of the purchase. After 10 days a credit note will be issued to the face value of the purchase. All refunds will incur a 25% administration charge, they will be processed at month end and will be made to the person who purchased the voucher. Any insurance fees paid will be forfeited.

Activated vouchers, booked experiences and special offers cannot be exchanged or refunded.

To request a refund the purchaser MUST return the voucher pack via recorded delivery to WrightStart, 1 Woodrising Close, Oakwood, Derby, Derbyshire, DE21 2SS along with a covering letter detailing the reason for your refund request and contact details which include an email address and telephone number.

Refund requests will not be dealt with over the telephone.

SECTION 11 – DAMAGE WAIVER

Damage waiver can be purchased for 10 pounds up until and on the day of the experience. WrightStart agree that should there be any damage to any of the WrightStart vehicles you drive on the day of your experience, you will not be liable for the first 500 pounds of damage as stated on the registration form.

SECTION 12 – SPECTATORS

Family and friends are welcome to come free of charge at our venue but photos and videos are not permitted outside of the waiting area. Extra drives and passenger rides are also available subject to availability.

Parking is limited to one vehicle per booked customer, you must present your parking ticket and booking confirmation to enter the car park.

SECTION 13 – ITINERARY CHANGES AND PROBLEMS DURING YOUR EVENT

On the rare occasion that a car you’ve booked to drive is unavailable you will be offered to either, drive another car as a replacement for the car that’s unavailable, and complete the remainder of the experience, or complete the remainder of the experience and re-book to drive the car that’s unavailable at a later date.

If a problem occurs during your experience please bring it to the attention of either the Duty Manager or the Chief Instructor on the day, and they will endeavour to deal with the problem whilst you’re at the venue. If we receive a letter of complaint without us being given the opportunity to rectify the problem whilst you’re at the venue, no refund will be offered retrospectively.

Privacy Policy

SECTION 1 – WHAT DO WE DO WITH YOUR INFORMATION?

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.

When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates.

SECTION 2 – CONSENT

How do you get my consent?

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

How do I withdraw my consent?

SECTION 3 – DISCLOSURE

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

SECTION 4 – THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

SECTION 5 – SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

SECTION 6 – COOKIES

We may use a variety of cookies to assist us in providing the best experience for you. We currently use a Google Analytics cookie (“__utm[a-z]”), a load balancing cookie (“DYNSRV”) and various session based cookies (if you log in to our website). Each cookie is used for its ultimate benefit to you, the visitor.

SECTION 7 – AGE OF CONSENT

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

SECTION 8 – CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.

Refunds Policy

Our policy lasts 7 days. If 7 days have gone by since your purchase, unfortunately we can’t offer you a refund or exchange. To be eligible for a return, your purchase must not have been redeemed. To complete your return, we require a receipt or proof of purchase.

If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days. If you haven’t received a refund yet, first check your bank account again. Then contact your credit card company, it may take some time before your refund is officially posted. Next contact your bank. There is often some processing time before a refund is posted. If you’ve done all of this and you still have not received your refund yet, please contact us at [email protected]. Only regular priced items may be refunded, unfortunately sale items cannot be refunded.
